2.1 Compliance Information

2.2 No Guarantee of Approval
We do not guarantee acceptance by any specific council, approval for any particular building consent, or ongoing compliance where standards or regulations change. Regulatory interpretation may vary by jurisdiction.
2.3 Quality Assurance
Where audits, inspections, or quality assurance are referenced, these may be performed by third parties or suppliers. We do not warrant that all goods are free from defects or suitable for every application.
2.4 Customer Responsibility
Customers must independently verify compliance and suitability for their intended use and specific project requirements.
3. Privacy Policy
3.1 Collection of Information
We may collect personal information including name, contact details, company information, enquiry details, and order information when you submit forms, make enquiries, place orders, or interact with the website.
3.2 Use of Information
We use personal information to respond to enquiries, provide services, manage orders and customer relationships, and improve website performance.

4. Supply Terms
NZ Imports supplies products through two distinct channels. The applicable terms depend on which channel your purchase falls under:
A) Online Store Purchases
These are standard product purchases placed and paid for through the website checkout (where available).
B) Bulk / Factory / MOQ Procurement
These are project, trade, or wholesale procurements arranged via quote, proforma invoice, or supply agreement (including factory orders, container orders, or minimum order quantity purchases).
If there is any inconsistency between online store terms and a written quote/proforma/supply agreement, the written agreement prevails.
5. Order Acceptance
All orders are subject to acceptance by NZ Imports.
An order is not binding until:
confirmed by NZ Imports in writing (including order confirmation, proforma invoice, or acceptance email), and
any required deposit or payment has been received.
We may decline or cancel orders prior to acceptance, including where products are unavailable, pricing errors occur, or compliance/regulatory/supply risks are identified.
6. Payment Terms
Unless otherwise agreed in writing:
6.1 Online Store
Payment is generally due at checkout (or as displayed at purchase).
Orders may be cancelled/refunded prior to dispatch if we cannot supply, at our discretion.
6.2 Bulk / Factory / MOQ
Typically 50% deposit upon order and 50% prior to dispatch from origin, unless otherwise stated in writing.
Production may not commence until deposit is received.
Payments must be made in cleared funds by the due date.
We reserve the right to suspend supply, withhold release of goods, and recover reasonable collection costs where payment is overdue.
7. Pricing, GST, Duties, and Charges
All pricing is indicative until confirmed in writing.
Unless otherwise stated:
Prices exclude GST, import duties, levies, port charges, storage, demurrage, regulatory fees, and inspection charges.
GST is payable at the applicable rate on taxable supplies.
Duties and government charges may vary and can change without notice.
Customers acknowledge that government charges and port/authority charges are outside our control and may be passed on prior to delivery.
8. Shipping, Delivery, Title, and Risk
8.1 Delivery Timeframes
Delivery timelines are estimates only and are not guaranteed.
8.2 Risk Passage
Unless expressly agreed otherwise in writing, risk passes to the customer at the point of dispatch or handover to the carrier, in accordance with agreed Incoterms and/or the agreed delivery method.
8.3 Title (Ownership)
Title to goods does not pass until NZ Imports has received payment in full (including all GST, freight, duties, and charges owed to NZ Imports under the relevant transaction), to the fullest extent permitted by law.
8.4 Freight Coordination
Where NZ Imports coordinates freight, this is provided as a facilitation service only. Carriers and freight providers act as independent contractors. Customers should maintain appropriate transit insurance unless otherwise agreed in writing.
9. Customs Clearance and Regulatory Responsibilities
Unless expressly agreed otherwise in writing:
The customer is responsible for customs clearance, import documentation, duties/taxes/levies, MPI/biosecurity requirements, and compliance with applicable laws and regulations.
Where NZ Imports assists with clearance or documentation, this is provided on a best-endeavours basis and we do not guarantee clearance outcomes or timeframes.
10. Inspection, Shortages, and Damage Claims
Customers must inspect goods promptly on delivery/collection.
Claims for shortages, incorrect items, or transit damage must be notified in writing within a reasonable time, and in any event before goods are installed or used. Supporting photos and delivery docket notes may be required.
Failure to notify within a reasonable time may limit remedies.
11. Returns, Refunds, and Cancellations
11.1 Online Store Purchases
Change-of-mind returns are only accepted if explicitly stated on the product page or at checkout.
If accepted, goods must be unused, in original packaging, and return freight may be at the customer’s cost. A restocking fee may apply.
Refunds (if approved) may exclude freight and payment processing fees where permitted by law.
11.2 Bulk / Factory / MOQ Procurement
Due to the nature of made-to-order and imported procurement:
Returns are not accepted for change of mind.
Cancellations after acceptance may incur costs already committed, including factory production, compliance/testing, freight, port charges, and administrative costs.
11.3 Defective or Non-Conforming Goods
Defects or non-conformance must be notified in writing within a reasonable time and goods must not be installed or altered prior to assessment. Remedies may include repair, replacement, or credit at our discretion, subject to supplier terms and applicable law.
NZ Imports does not accept responsibility for installation costs, removal costs, rework costs, project delay costs, or consequential loss.
12. Warranties and Product Responsibility
Unless expressly stated:
Product warranties are provided by the manufacturer or supplier, not NZ Imports.
We do not provide performance guarantees beyond those supplied by manufacturers or certification bodies.
Customers are responsible for confirming suitability for intended use and ensuring products meet project-specific consent, design, and specification requirements.
13. Limitation of Liability
To the fullest extent permitted by law:
NZ Imports is not liable for indirect, consequential, or economic loss.
Our total liability is limited to the value of the goods or services supplied giving rise to the claim.
Nothing in these terms limits rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where applicable.
14. Governing Law
These terms and all orders and transactions are governed by the laws of New Zealand. The New Zealand courts have exclusive jurisdiction.
